Terms of Service

----------------------------------By commissioning me (‘the Artist’), you (‘the Client’) agree to the following Terms of Service (‘TOS’):1. General(a) All commissions are digital and do not include shipping;(b) The Artist reserves the right to decline any offer without explanation;(c) The Artist holds all rights and copyright to their work, which includes but is not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales or self-promotion. By purchasing a commission, the Client is only purchasing the Artist’s labour;(d) If the Client would like the commissioned art to remain private (i.e. not published anywhere), an additional fee will be charged;(e) Commissioned art may only be used for personal use (see 5. Terms of Use);(f) The commissioned art cannot be used for Non Fungible Tokens (‘NFTs’).2. Payment(a) Payment is due in full, upfront via Paypal only before the Artist can start the commission;(b) Payment must be made in USD or the AUD equivalent;(c) For amounts greater than $100 USD, payment plans are available if the Client so requires. Until full payment is made, the Artist will only provide low-resolution and/or watermarked version(s) of the commissioned art.3. Process(a) The Artist will proceed after payment is received;(b) The commissioned art may take 1 to 4 weeks, contingent on the Artist’s personal commitments. The Artist will notify the Client if any delays arise;(c) The Client may contact the artist for updates at any given time;(d) The Client will be provided with a sketch work in progress (‘WIP’) for the Client’s approval. At this stage, the Client may ask the artist to make small changes.4. Refunds and Cancellations(a) The Artist does not provide refunds, unless the Artist informs the client that they can no longer complete the order, in which case, a 100% refund will be provided to the Client;(b) Chargebacks will not be tolerated under any circumstances. The Client will be automatically blacklisted from the Artist’s services.5. Terms of Use(a) The Client is permitted to use the commissioned art for personal use only; commercial use is prohibited;(i) Commercial use includes the Client profiting from the commissioned art by way of selling prints, products or NFTs.(ii) Printing for personal use (e.g. to use as a poster) is acceptable. Other forms of personal use that is acceptable include using the commissioned art as a phone/computer wallpaper background, profile picture (with credit), uploading to social media (with credit), or any other non-commercial digital format.(b) The commissioned art cannot be edited without the Artist’s permission. Resizing or cropping the commissioned art is acceptable;(c) Contravention of 5(a) or (b) will result in the revocation of the Client’s right to use the commissioned art.
The TOS are subject to revision without notice. The Client must read and understand the TOS before entering into a Commission Agreement with the Artist. Once the Client enters into a Commission Agreement with the Artist, it is assumed that the Client has agreed to all TOS.
